Summary Emily became a tenant in 2004 following the successful completion of her pupillage in Chambers. She undertakes both court and advisory work in the areas of housing, business tenancies, administrative and local government law including landlord and tenant, mortgages, homelessness, housing benefit, anti-social behaviour, nuisance, disrepair and possession claims.



Emily has acted for public and private sector clients including a number of local authorities and she is frequently instructed by solicitors outside London. She has a good reputation for her knowledge and experience in cases involving allegations of  anti-social behaviour (including appeals to the Crown Court and High Court). More recently, Emily has been instructed on a number of claims for judicial review for both claimants and defendants and has enjoyed particular success in cases concerning homeless applications.

Housing All aspects of housing law including bringing and defending mortgage claims, LVT applications, succession of tenancies and nuisance claims (public and private).
Local Government Including bringing and defending homelessness appeals, s.222 Local Government Act 1972 Injunctions, duties owed to children, allocation policies, delegation of functions to ALMOs.
Landlord and Tenant Including possession claims (private and public sector), commercial tenancies, disrepair, unlawful eviction, applicability of Disability Discrimination Act 1995.
Right to Buy All aspects of procedure and policy including eligibility to exercise the right to buy and validity of statutory notices.
Housing Benefit Advising on applications, defending and bringing appeals, general application to rent possession claims.
Anti-Social Behaviour All aspects of anti-social behavior including ASBOs in the Magistrate’s and County Court and appeals to the Crown Court, Parenting Orders, Individual Support Orders, Protection from Harassment Act 1997, Anti-Social Behaviour Injunctions and nuisance possession claims.

  • Birmingham City Council v (1) VB (2) HC (3) F [2008] EWHC 1224 (QB), led by Jonathan Manning. Application of s.222 of the Local Government Act 1972 to drug dealers in a local authority area.
Homelessness
  • R (Hassan) v Croydon LBC CO/97302008, January 13, 2009, HH Judge Mackay. LAG, March 2009, p.25; JHL, Vol 12, Issue 3, 2009, p.D56. Whether local housing authorities are obliged to have regard to duties owed to an applicant’s children when deciding whether to terminate interim accommodation under s.188(3), Housing Act 1996.

In her personal time, Emily enjoys running, gardening, horse riding and martial arts and was awarded a 2nd Degree Black Belt in taekwondo in April 2009.
