Toby Vanhegan

Prior to his call to the Bar in 1996, Toby Vanhegan read law at Oxford University, an LLM   at King’s College, London University and was an Astbury Scholar of the Middle Temple. 

His practice covers all areas of housing law, but because of his knowledge of immigration and asylum law, he has a particular expertise in cases that involve the eligibility of immigrants and asylum seekers for housing and other forms of social assistance. 

Toby has experience of all kinds of possession claims, in particular those brought on the grounds of nuisance, anti-social behaviour, succession, and arrears of rent. His experience also covers homelessness appeals, issues concerning temporary accommodation, community care, disrepair, ASBOs, injunctions, committal applications and housing benefit matters.  

His property practice covers both residential and commercial landlord and tenant work, including lease renewals, boundary disputes, actions for trespass, adverse possession claims, mortgage repossessions, easements, trusts of land and charging orders.

Toby acts for local authorities, social and private landlords, tenants, applicants for homelessness assistance, immigrants and asylum seekers and the like.  

Toby also has considerable experience and knowledge of public law including human    rights, EU law, immigration and asylum. He has particular expertise in EU free movement law. His asylum work covers a wide range of countries and he deals with all types of entry clearance applications and appeals. 

He appears in all sorts of courts and tribunals, including the Court of Appeal, the High Court especially the Administrative Court, and the Asylum and Immigration Tribunal. He also has a case in the European Court of Justice.
